2. Our Services

Sendivia is a performance-based cold email outreach agency. We build and run outbound email systems that book qualified sales calls for B2B companies. Clients pay only when a qualified call is booked — never for emails sent, leads sourced, or unqualified conversations.

This Site is informational. If you become a client, your engagement is governed by a separately signed services agreement. If anything in a signed agreement conflicts with these Terms, the signed agreement controls for that engagement.

3. Using the Site

You may use the Site to learn about our services, review case studies, or book a strategy call. You agree that you will not:

• Scrape, crawl, or harvest content or data from the Site by automated means without our written permission.
• Probe, scan, or test the security of the Site, or interfere with how it works.
• Submit false or misleading information through any form on the Site.
• Use the Site for any unlawful purpose.

Our Acceptable Use and Anti-Spam Policy also applies to your use of the Site.

4. Intellectual Property

The Site and everything on it — including text, design, logos, and case study content — belong to Sendivia or our licensors. We grant you a limited, revocable licence to view the Site for your own business evaluation or personal use. You may not republish, copy, or distribute Site content without our written permission.

5. Third-Party Services

The Site links to services run by other companies, including Calendly (for booking calls). Those services have their own terms and privacy policies, and your use of them is governed by those terms. We are not responsible for third-party services or content.

6. Disclaimers

The Site and its content are provided "as is" and "as available", without warranties of any kind.

Case studies and statistics on the Site describe real, historical results for specific clients. They are examples, not promises. Past results do not guarantee any future outcome for your business. Any performance commitments we make to a client are set out only in that client's signed services agreement.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Sendivia will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost data, arising out of your use of the Site.

8. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Germany. Any dispute arising from these Terms or the Site will be resolved exclusively in the courts of Berlin, Germany.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and update the "Last updated" date at the top. Your continued use of the Site after a change means you accept the updated Terms.
